Section No. 8 Of Suits Valuation Act 1887

(1) Introduction

Suits Valuation Act has provided provisions for determination of suit valuation for purpose of court fee and for purpose of jurisdiction of court. This act consists of two parts. In its Part II, provision has been provided about same court fee value and jurisdictional value in certain suits. This provision has been provided in Section No. 8 of this Act,

 (2) Section No. 8 Of Suits Valuation Act

Following points are important for explanation of Section No. 8 of Suits Valuation Act:

When court-fees are payable ad valorem under Court-fees Act in those suits, which are other than those suits, which have been referred to in paragraphs (v), (vi) and (ix) and clause (d) of paragraph (x) of Section No. 7 of Court-fees Act, 1870, value as determinable for computation of court-fees and value for purposes of jurisdiction shall be the same.

Following points are important for explanation of object of Section No. 8 of Suits Valuation Act:

(a) Same court fee value & jurisdictional value

(b) Different court fee value & jurisdictional value

(c) Determination of court fee value &

(d) Jurisdictional value

(e) Non-application of Section No. 8

 

(a) Same Court Fee value & Jurisdictional Value

According to this section, court fee value and jurisdictional value should be same in those certain cases, which are other than those suit, which have been referred in paragraphs (v), (vi) and (ix) and clause (d) of paragraph (x) of Section No. 7 of Court-fees Act, 1870.

(b) Different Court Fee Value & Jurisdictional Value

In these suits, different court fee value and jurisdictional value cannot be given. Even plaintiff is not entitled to give low court fee value and high jurisdictional value because he/she is to give same court fee value and jurisdictional value in these suits.

(c) Determination Of Court Fee Value & Jurisdictional Value

Under this section, it is necessary that court fee value should be determined first, and jurisdictional

value should follow court fee value

(d) Non-application Of Section No. 8

This section cannot be applied to those cases in which separate relief is claimed in alternative in respect of suit property.

(3) Conclusion

To conclude, it can be stated that Section No. 8 of Suits Valuation Act is applicable to appellate courts and lower courts.
