Trade union means any combination of workmen or employers, which is formed primarily for purpose of regulating relations between workmen and employers or relations between workmen and workmen or relations between employers and employers or for imposing restrictive conditions on conduct of any trade or business, and includes a federation of two or more trade unions.

(i) Application

Under signatures of its president and secretary, any trade union is to apply to Registrar for its registration.

(a) Statement

This application should be accompanied by a statement. Following points are important for

Constitution of trade union should provide name and address of trade union.

(b) Objects

Constitution of trade union should provide those objects for which trade union has been formed.

(c) Purposes

Constitution of trade union should provide those purposes for which general funds of union are to be utilized.

(d) Executive

Constitution of trade union should provide number of those persons, who form executive, and this number should not exceed prescribed limit.

(e) Conditions

Constitution of trade union should provide those conditions under which a member is entitled to any benefit, which is assured by constitution of trade union, and under which any fine or forfeiture can be imposed on him/her.

(f) List Of Members

Constitution of trade union should provide maintenance of a list of members of trade union and of adequate facilities for inspection of such list by office-bearers and members of trade union.

(g) Manner For Amending, Varying & Rescinding Of Constitution

Constitution of trade union should provide manner in which constitution shall be amended, varied or rescinded.

(h) Safe Custody Of Funds

Constitution of trade union should provide safe custody of funds of trade union, its annual audit, manner of audit and adequate facilities for inspection of account books by office-bearers and members of trade union.

(i) Dissolution Of Trade Union

Constitution of trade union should provide manner in which trade union can be dissolved.

(j) Election Of Office-Bearers

Constitution of trade union should provide manner of election of office-bearers by general body of trade union and term, which should not exceed two years, for which an office-bearer can hold office upon his/her election or re-election.

(k) No Confidence

Constitution of trade union should provide procedure for expressing no confidence in any office-bearer of trade union.

(l) Meeting Of Executive & General Body

Constitution of trade union should provide meeting of executive and of general body of trade union; executive should meet at least once in every three months and general body should meet at least once in a year.

(m) Engagement Or Employment

All members of trade union should be those workmen, who should be actually engaged or employed in establishment or group of establishments or industry with which trade union is connected.

(n) Two Or More Registered Trade Unions

Number of members of trade union should not be less than one-fifth of total number of workmen, who have been employed in that establishment, group of establishments or industry with which trade union is connected, where there are two or more registered trade unions in such establishment, group of establishment or industry.

(o) Women As Workers

If women are employed as workers in establishment, group of establishments or industry with which trade union is connected, trade union is to include female workers in executive body.

(iv) Registration

Here following points are important:

(d) In case of further delay

 

(a) Registration & Registration Certificate

When Registrar is satisfied that trade union has complied with all requirements of this Act, he/she is to register trade union in a prescribed register and issue a registration certificate in prescribed form within a period of fifteen days from date of receipt of application.

(b) Written Objections

If Registrar founds this application deficient in a material respect, he/she is to communicate his/her written objections to trade union within a period of fifteen days from receipt of application and trade union is to reply to these objections within a period of fifteen days from receipt of objections.

(c) Solution Of Objections

When these written objections have been satisfactorily met, Registrar is to register trade union in a prescribed register and issue a certificate of registration in prescribed form within fifteen days of date of communication of reply of objections.

(d) In Case Of Further Delay

In case of further delay, Registrar can register applicant trade union provisionally till further orders.
