Which documents are exempted from payment of Court Fee?

Documents Exempted From Payment Of Court Fee

Followings are those documents, which are exempted from payment of court fee:

(i) Power of attorney

(ii) Written statements

(iii) Probate of will, letters of administration & securities & certificate

(iv) Application or petition to collector or other officer

(v) Application about supply of water for irrigation

(vi) Application for leave to extend cultivation or to relinquish land (vii) Application for service of notice

(viii) Written authority

(ix) First application for summons

(x) Bail-bonds in criminal cases & recognizanzes

(xi) Petition by prisoner or other person

(xii) Complaint (xiii) Application for permission

(xiv) Application for payment of money

(xv) Petition of appeal

(xvi) Application for compensation

(xvii) Petition under Christian Marriage Act

 

(i) Power Of Attorney

No court fee is chargeable when power-of-attorney is to institute or defend suit and this power of attorney has been executed by an officer, warrant officer, non-commissioned officer or private of Pakistan Army not in civil employment

(ii) Written Statements

No court fee is chargeable if written statements has been called for by court after first hearing of suit.

(iii) Probate Of Will, Letters Of Administration & Securities & Certificate

No court fee is chargeable when there are probate of a will, letters of administration, and securities and a certificate under Sind Regulation VIII of 1827 where amount or value of property in respect of which probate or letters or certificate is granted does not exceed one thousand rupees.

(iv) Application Or Petition To Collector Or Other Officer

 

No court fee is chargeable if application or petition has been made to collector or other officer, who is to make settlement of land revenue, or to Board of Revenue or Commissioner of Revenue, and if this application or petition relates to those matters, which are connected with assessment of land or ascertainment of rights or interests of land, and if this application or petition has been presented previous to final confirmation of settlement of land revenue.

(v) Application About Supply Of Water For Irrigation

No court fee is chargeable when application relates to supply for irrigation of water, which belongs to government.

(vi) Application For Leave To Extend Cultivation Or To Relinquish Land

No court fee is chargeable if there is application for leave to extend cultivation or to relinquish land when this application has been presented to officer of land-revenue by that person, who holds land under direct engagement with government, and this land should be that land of which revenue is settled, but is not settled permanently.

(vii) Application For Service Of Notice

No court fee is chargeable when there is application for service of notice of relinquishment of land or for service of notice of enhancement of rent.

(viii) Written Authority

No court fee is chargeable if there is written authority to an agent to distrain.

(ix) First Application For Summons

No court fee is chargeable when there is first application, which is other than that petition, which contains criminal charge or information, and this first application is for summons of a witness or other person to attend either to give evidence or to produce a document or this application is in respect of production or filing of an exhibit, which is not an affidavit.

(x) Bail-Bonds In Criminal Cases & recognizances

No court fee is chargeable if there are bail-bonds in criminal cases, recognizances to prosecute or give evidence, and recognizances for personal appearance or otherwise.

(xi) Petition By Prisoner Or Other Person

No court fee is chargeable when there is petition by prisoner or by other person, who is in duress or under restraint of any court, or by officers of court.

(xii) Complaint

No court fee is chargeable if there is complaint of that public servant, who has been defined in Pakistan Penal Code, a municipal officer or an officer or servant of Railway Company.

(xiii) Application For Permission

No court fee is chargeable when there is application, which is for permission to cut timber in government forests or which otherwise relates to such forests.

 (xiv) Application For Payment Of Money

No court fee is chargeable if there is application for payment of that money, which is due by government to applicant.

(xv) Petition Of Appeal

No court fee is chargeable when there is petition of appeal against any municipal tax

(xvi) Application For Compensation

No court fee is chargeable if there is application for compensation under any law for the time being in force when this law relates to acquisition of property for public purposes.

(xvii) Petition Under Christian Marriage Act

No court fee is chargeable when there is petition under Christian Marriage Act.
